Terms of Service
Effective date: March 1, 2024
These terms form a contract between you (“Customer”) and mailb0x Labs. By creating a workspace or using our services, you agree to the following.
1. Services
We provide software for email deliverability management, including SMTP orchestration, warmup automation, analytics, and related tooling. Access is granted on a subscription basis.
2. Accounts
Customers must maintain accurate contact and billing information. Workspace owners are responsible for user activity within their organization.
3. Acceptable use
You agree not to use mailb0x for unlawful content, unsolicited bulk messaging without consent, or activity that violates ISP or anti-spam policies. Misuse may lead to suspension.
4. Data & privacy
We process data as described in our Privacy Policy. Customers remain controllers of the data they upload.
5. Payment
Fees are billed in advance. Late payments may incur interest or lead to service suspension. Subscription renews automatically unless canceled prior to the renewal date.
6. Confidentiality
Both parties agree to protect confidential information and use it solely for providing or receiving the services described here.
7. Warranties & disclaimers
We warrant that the services will operate materially in accordance with documentation. We disclaim other warranties to the fullest extent permitted by law.
8. Liability
Our aggregate liability is limited to fees paid in the 12 months preceding the claim. Neither party is liable for indirect or consequential damages.
9. Term & termination
Either party may terminate for uncured breach or upon notice before renewal. Upon termination, we will provide data exports upon request.
10. Governing law
This agreement is governed by the laws of Germany, with disputes settled in Berlin courts, unless otherwise specified in your enterprise agreement.
We may update these terms. Continued use after updates constitutes acceptance. For custom terms, contact legal@mailb0x.dev.
